Grand Juries

A grand jury's primary function is to listen to the evidence presented by the prosecutor and decide if someone should be indicted for a crime. The Fifth Amendment of the United States Constitution provides that all federal criminal charges must be brought by a grand jury indictment. About half the states use grand juries. The grand jury also has broad power to investigate crimes. Some states permit grand juries to investigate corruption, organized crime, and the alleged misconduct of public officials. An investigative grand jury has the power to subpoena witnesses.

Independence of the Judiciary

An independent judiciary is a fundamental principle of our democracy. The founding fathers assured the independence of federal judges by giving them tenure for life. The United States Constitution also prevents the reduction of a federal judge's salary while he/she is in office. The founding fathers also specified that federal judges could only be impeached and removed from office for committing treason, bribery, or other high crimes and misdemeanors.

Representing Yourself in Court

If you represent yourself in court and don't use an attorney, you are acting "pro se." Pro se is a Latin term that means on your own behalf. In legal terms, you are considered a self-representing party.

The Effect of a Judgment in a Civil Lawsuit

When a court of competent jurisdiction renders a final judgment on the merits of a case, the judgment is conclusive between the parties as to the claims, facts, and issues litigated in the case.

Courthouse Security

Courthouse security has been increased since events such as the Oklahoma City bombing of a federal court building and the tragedy of September 11, 2001, which destroyed the Twin Towers of the World Trade Center in New York City. The goal of enhanced security is twofold: to assure the safety of people and property in the courthouse and to preserve the integrity of the judicial process. Reasonably safe courthouses must be provided, measures have to be taken to safeguard court records, and a plan must be adopted that would permit the court system to function after an emergency.
